He asked for matches, which she gave him. She started churning again. The defendant then sat clown on the sofa. Then he caught her dress and said she wanted a new one. He then asked her to shake hands, which she refused. Defendant caught her by the shoulders and pushed her in the corner of the kitchen. He then endeavoured to assault her. She fought and screamed. She got away and ran Into the garden. Her little girl was coming out of the garden. The defendant went away. Her husband returned between 7 and 8 p.m., and she made a complaint.
John Sherrin, farmer, deposed that on returning from town about 7 or 8 p.m. his wife made a complaint to him. He informed the police.
Alfred James, prospector, Enoggera Ranges, deposed he knew the defendant. Defendant said he had got into a row with Sherrin. He had called there for matches, and Mrs. Sherrin was churning at the time. He caught her hand, she screamed out, and he caught her hand tighter.
William Wray, labourer, Brunswick street, Valley, deposed he called at Mrs. Sherrin's house for matches. She gave him a box. On leaving she offered him her hand, and he took hold to shake it. As soon as he did so she screamed out, and tried to bound out of the room. He caught hold of her, and, doing so, slipped on potato skins. He fell against her, and knocked her against the wall.
His Honour summed up, and the jury retired.
The jury found a verdict of " Not guilty," and the defendant was discharged.
