Narrative
Police Office, 21st June. — Present — Gilbert Eliott, G. B. Suttor, aud J. Blaxland, Esqrs.
Joseph Hendle, publican, was summoned to answer to an information charging him with having, on the 10th day of June; committed a breach of the Licensing Act, by "supplying" one-half gill of rum on that day, it being a Sunday.
Inspector Fox deposed to having met a man named Longbottom, on Sunday, the 15th instant, who was intoxicated at the time, and from whom he had received certain information with which he had been induced to acquaint the chief constable. James Longbottom stated that he went to defendant's house on the day alluded to in the information, that he called for a gill of rum, which was supplied him, and he drank it; that he was sober at the time.
Joseph Williams stated that he accompanied the last witness to Hendle's house, hut did not hear any drink called for, nor see any supplied ; neither Longbottom or himself were drunk, but might have had a glass.
William Dunster, builder, deposed to having been in the house of Mr. Hendle when the two last witnesses came ; they were both drunk ; Longbottom called for some thing to drink, but the landlord would not serve him, upon which they made use of bad language, and were forth with turned out of the house. The magistrates very properly dismissed the case, and we must beg to observe it appears strange to us that Inspector Fox should have deemed it necessary to prefer a charge in such a case, when he was fully aware that the man Longbottom was intoxicated at the time he gave the information, consequently disqualified from being received as a credible witness.
