Hendle and Others v. Qualtrough and Another.

This was an action in which William James Hendle, a butcher, residing at Nundah, and his wife, Lucy, and W. J. Heirdsfield were the plaintiffs, and Walter H. QuaItrough, a plumber, and Elizabeth Matilda Qualtrough, widow of William Qualtrough, deceased, were the defendants. The statement of claim set out that George HeirdsSeld, in 1866, was the owner of a piece of land near the corner of Wickham and Brunswick streets, 14½ perches, being part of subdivision 4 of block 6 of eastern suburban allotment 71.
On 18th December of that year he applied to have the land brought under the Real Property Act of 1861, and requested the Registrar of Titles to issue the certificate of title in the name of William Qualtrough, his brother-in-law. The latter had given no consideration for the land, but in pursuance of Heirdsfield's application, the fee simple of it was transferred to him. Wm. Qualtrough died on 31st August, 1870, without having disposed of the land, or of any estate in it. By his will, dated 4th July, 1864. and a codicil dated 14th May, 1869, he devised all his real estate to his wife, Elizabeth Matilda, and T. B. Stephens, upon certain trusts. Mr. T. B. Stephens died in April. 1890, and Elizabeth Matilda Qualtrough appointed the defendant. W. H. Qualtrough, as a trustee in his place. Qualtrough declaring himself a trustee of the lands in question for Geo. Heirdsfield. The latter died in November, 1890, intestate, leaving surviving him six children.

The civil sittings of the Supreme Court were continued yesterday, before his honour Mr. Justice Chubb, and a jury.
CLAIM FOR DECLARATION OF TITLE.
In the matter of W. J. Hendle and others v. W. H. Qualtrough and another, claim for declaration of title, &c.
Mr. Stumm, with him Mr. Fewings (instructed by Messrs. Atthow and M'Gregor), appeared for the plaintiffs ; Mr. E. M. Lilley (instructed by Messrs. Roberts and Roberts) appeared for the defendants.
The jury was: Messrs. John T.Williams, L. F. Schoenheimer, Edmondstone Markwell, and Peter M. Campbell.
Lucy Hendle, further cross-examined by Mr. Lilley, stated that Mrs. Qualtrough had bought another piece of property for her sister and given it to her on similar terms to those she had given the land to witness. Her brother William and she had gone to Mrs. Qualtrough and asked who had authorised her to sell the Brunswick street property. Witness had not taken the certificate of title of the land out of Mrs. Qualtrough's house. Re-o=examined by Mr. Stumm: She had never been charged with stealing the certificate of title. The first time she had heard it suggested was that morning. George M. Jones, a deputy registrar of titles, produced documents relating to the Brunswick street property.
William John Heirdsfield, a miner residing at Gympie, stated that he went to see Mrs. Qualtrough in 1891, she having sent a message for him. She told him that there was £100 for him but she would not give it to him until he went away. She further told him that only for his brother George she would not have given him a penny. She gave him £100 on tbe day before he went away, and said there was more coming to him, but she would see how he got on with that. She told him that his sister (Lucy) wanted all the money, and that she would put away what belonged to his other brothers in the bank until they could take care of it. She also told him that it had taken some of the money to pay for his father's keep in Dunwich. He said he did not see how that could be, as he had been paying 12s. 6d. per month for his father's keep in Dunwich, and had paid some £14 or £15. His brother was, he believed, paying a similar amount per month. He remembered going to Mrs. Qualtrough's with Mrs. Hendle to ask her who had given authority to sell the property, and was ordered out of the house.

William Brundrit, accountant in intestacy, stated that the deceased George Heirdsfield went to Dunwich in October, 1886. He left on August 4, 1887, and returned on September 29, 1887. He was discharged again on August 31, 1888, and returned on February 12, 1889. He left on May 8, 1889, and returned on May 29 of that year, remaining there until he died in 1890. The son George Heirdsfield had contributed £9 15s. 10d. towards his father's support, and William J. Heirdsfield £14 10s. 5d.

Thomas Hare was
charged with assaulting a boy named Charles Heirdsfield. From the evidence of the boy's father it appeared that Hare had come up to the door while the boy was sitting there, and without a word threw him on his face, tore his shirt, and knelt on him. From an explanation made by defendant it seemed that he had taken the boy to be one of a number who had just previously been throwing stones at him, and who had run up the street. He was fined 10s., or twelve hours' imprisonment.

OBITUARY.
CHARLES JOSEPH HENDLE.
The death occurred yesterday morning of Charles Joseph (Joe) Hendle, butcher, employed at Giffin's butcheries. Deceased, who was 54 years of age, and was a Queenslander by birth, had been in this district for very many years, and was particularly well known in the Mareeba area. Besides a wife he leaves three sons, Messrs. W. and C. Hendle, of Mareeba, Mr. A. Hendle, of Brisbane, three daughters, Miss Elsie Hendle, Mrs. Charles Tilse, and Mrs. A. Lane, of Mareeba. The funeral took place from St Johns Church yesterday afternoon. There very many relatives and friends present. Rev. Maloney officiated at the church and graveside.

Brisbane Father And Daughter Die On Same Day
A man and his daughter died within a few hours of each other on Tuesday, and their funerals took place yesterday.
The father was Mr. William James Hendle, 88, of 35 Kedron Park Road, Wooloowin, who had been ill for a long time, and his daughter was Mrs. Esther Maud Byrne, of 104 Abbotsford Road, Mayne Junction, who met with an accident a year ago.
Mrs. Byrne's funeral left the Adelaide Street funeral parlour of Cannon and Cripps at 10 a.m. yesterday for the Mt. Thompson Crematorium, and her father's funeral left the same parlour for the Toowong Cemetery at 2.30 p.m.

In the Magistrate's Court this morning, before Mr. T. H. Boddington, P.M., the Queensland Trustees and John Gaydon, of Toowoomba, executors and trustees of the will of Martha Newman, deceased, proceeded against W. J. M'Donald, of Oakey, for the recovery of £100, due under a promissory note to Martha Newman, deceased.
Messrs. Bernays and Bernays appeared for the plaintiffs, and Mr. Rutledge for defendant.
W. J. M'Donald, in his evidence, stated that he was a brother-in-law of deceased. She had lent him £100 in October, 1918, for which he gave a promissory note. Later he gave a second promissory note with slight alteration, and the first one was to be cancelled, but could not be found.
After hearing evidence, the P.M. found for defendant, costs to be taxed.
