Share in estate after 60 years
COURT RULES ON 1890 WILL
ALTHOUGH the father of Agnes Lucy Slaughter excluded her from his will 60 years ago the Full Court decided yesterday that she was entitled to a share of his estate. Her father, William Blackford, once a Brisbane wholesale fruiterer, lost his life in the wreck of the Quetta in Torres Strait on February 28, 1890. Blackford was married three times, and was the father of 13 children. None died before him. His third wife, Alice Blackford, lived till January 4, 1946. Her death, and the passage of years, caused Queensland Trustees, Ltd., to ask the Full Court yesterday to interpret Blackford's will, which he made in the 'Colony of Queensland,' on January 28, 1890. There were two children of the first marriage. One is dead, the other, Agnes Lucy Slaughter, is alive. Five were the issue of the second marriage, of whom four are dead, and one, Henrietta Biggs, is alive. Six children were born of the third marriage, and five are still living. Blackford willed that his widow should be entitled to live in his home at Gregory Terrace, Brisbane, and to receive from his estate £6 a week to keep herself and their infant children. Two excluded He also directed that his trustees should accumulate the rest of the income from his estate, to pay each child £200 on reaching the age of 21. But he excluded the two children of his first marriage from any share of his estate. When Blackford died he left £11,474. The surplus income accumulated partly over the 21 years after Blackford's death and partly after that period till his widow's death. The accumulations now total about £4000. The Chief Justice said that the Accumulations Act of 1800 restrained accumulation for any longer term than 21 years from the testator's death. It was clear accumulation in this case came within the prohibition of the Act after March 1, 1911. The persons entitled to share under the intestacy were Blackford's widow and his children, who survived him, and the respective estates of the children who had since died. Mr. Justice Mansfield, S.P.J., and Mr. Justice Townley agreed. Mr. P. P. Wright, instructed by Chambers. McNnb and Co., appeared for Queensland Trustees Ltd., Mr. B. J. Jeffriess, instructed by Mr. H. R. Gordon, for Henrietta Biggs and the children ot the third marriage, and Mr. C. G. Wanstall, instructed by Messrs. John H. Scott and Crawford for Agnes Lucy Slaughter, the estate of the widow, and the estate of the deceased daughter of the first marriage.
