The news of the death of Mr. Harry Scarr came as a very great shock to his many friends. Mr. Scarr has been in New Zealand with his bride (Miss Moody), of Sussex Street, South Brisbane, when he contracted blood poisoning; when he returned to Brisbane he got worse, and went into Victoria Private Hospital; but evidently the poison was too deeply rooted. Poor old Harry, as everyone says; he was such a great favourite, good-natured to a fault, and never had an enemy. He was the eldest son of Mr. and Mrs. William Scarr, who lived so many years at New Farm, very old and respected Brisbane residents. Mr. Harry Scarr was educated at the Grammar School, and was captain of their football team for years. He was a good athlete and a general in anything he undertook to do. By profession, an architect. Mr. Scarr had the honour of representing Queensland in every position in the field, from full-back to forward. He worthily represented his State since early in the eighties. He was one of the most unselfish players. The deepest sympathy is felt for his young wife and his family. At the funeral, which took place at Toowong, the ceremony was most impressive. His old mates being very effected. The floral tributes of sympathy were beautiful and covered his grave.

The marriage of Mr A. E. Sluman to Miss Alice Mary Scarr (only daughter of Mr. W. Scarr, late of New Farm) took place at Trinity Church, Valley, on the 17th instant. The ceremony was performed by the Rev. J. Spooner. The bride, who was given away by her father, wore a pretty gown of dove-coloured silk, and a hat of white chiffon and lace. The only bridesmaid, Miss Ada Moody, wore a pale-blue costume. M. C. Harrison acted as best man. Immediately after the ceremony Mr. and Mrs. Sluman drove to the Melbourne-street Station, en route for Cleveland, where the honeymoon will be spent. Previous to the ceremony Mrs. Scarr entertained about forty guests at afternoon tea at Dunkeld. The bridal costume was from the establishment of Messrs. Chapman and Co.

IN MATRIMONIAL JURISDICTION

Before his Honour the Chief Justice.

William Albury, a fruitgrower, of Zillmere, petitioned for a dissolution of his marriage with Ruth Jessie Albury (nee Josey), the grounds being alleged adultery with Horace Lancaster Scarr, traveller, of Brisbane, on various occasions at Gympie, Maryborough, and Rockhampton. The petitioner also sought for the custody of the four children, the issue of the union. The parties were married at Redbank Plains, Goodna, by the Rev. Mr. Davies, of the Church of England, on 7th June, 1893.

Mr. P. P. Fewings (instructed by Messrs. Atthow and M'Gregor) appeared in support of the petition. The suit was undefended.

Arthur W. Dring, clerk in the office of plaintiff's solicitors, gave evidence of serving copies of the petition on defendant and on the co-defendant at Singer's sewing machine shop. In company with plaintiff and his brother, he saw Scarr and Mrs. Albury on one occasion go to a boarding-house kept by Mrs. Ross, in Gotha-street, Valley. He afterwards went to the house, and asked for Mrs. Scarr. Mrs. Albury came out. Mrs. Ross said she knew the lady as Mrs. Scarr. Albury identified her at the same time as his wife.

Samuel H. Walker, articled clerk in the office of plaintiff's solicitors, gave evidence of posting notices of trial. The petitioner, William Albury, gave evidence of his marriage with defendant, and the issue. He lived happily with his wife until she went to her sister's place at Goodna on 6th July last year. The first time he saw Scarr was about a year after the marriage. Scarr was then working for a brother-in-law of his (Albury's). In June last year he came to the house on two Sunday afternoons. Mrs. Albury had a sick baby with her when she went to Goodna. On 26th July he received a letter from his wife saying she had gone, and that the baby was left there for him to take home. Up to this time they had had no quarrel. He did not know where his wife was gone, and therefore laid information at the Criminal Investigation Branch. The officers found her at Gympie. Witness received several letters from her, stating she was never coming home, and that she was living with " her husband, Horace Scarr." The letters were signed " Scarr." About September his wife wrote to him to come and bring her home. He did so. She stated she could not stay away from the children. She was very penitent, and said she would make up for her absence, and be a good wife and mother. Believing she would remain, he destroyed the letters he had received from her. After about ten days his wife said she was going away again, as "she could not live away from Horace." The latter sent her a registered letter, "and away she went" for Gympie. Witness got the letter, and gave it to her. She left in the Gladstone mail train ; but witness did not go to the station. Subsequently he received a letter from her, from Gundiah.

The letter, which was read, stated that the writer was living with Mr. H. L. Scarr as his wife " Nothing will ever part us," it said. " I will stand by my darling's side. .... He is all the world to me. . . . I think the best thing you can do is to get a divorce. You may be able to get some one you can love. I shall never be jealous. . . . I never could love you and I never did. ... I am very, very happy with dear Horace."- Other letters were also produced, but not read.

Witness, continuing, said he received letters also from Gympie, Maryborough, and Rockhampton. A letter from the last named place, dated 24th December, 1899, asked him to take his wife back. He never answered any of the letters. On New Year's Day, on returning from his holidays, he found his wife in the house, and the baby (which she had taken with her) in bed. He asked her what she meant by coming backwards and forwards, as she said she was going to be true. She said she had come to stay. he said, " Very well," and the matter was made up. She remained five weeks, and then one day he saw her packing up. He asked her where she was going, and she said, " Back again." She seemed as if she could not live away from Scarr. He did not see her again until she stopped him in the street one day. She said she was living at Mrs. Ross's place. He did not see her again until 6th April, when he went with his brother and Dring to Mrs. Ross's house. His wife was out the first time, and they went along the street, when he saw his wife and Scarr walking past. They watched them back to Mrs Ross's place, and there he identified his wife. Mrs. Ross, who was present, said the couple had been living there as man and wife for several weeks. Witness denied that he was in collusion with his wife in connection with the divorce.

To his Honour : He had no suspicion of the time it was arranged his wife should go to Gympie.

Elizabeth Ross, a widow, residing at Gotha-street, said she kept a boarding house. Defendant and the co-defendant came to her house together in the second week in February, and represented themselves, under the name of Mr. and Mrs. Scarr, as man and wife. They took a room. He said he was a commission agent in the Singer Sewing Machine Company. They remained there until 6th April, when Albury came, and declared she was his wife.

Up to that time she had no suspicion that the woman was not married.

His Honour granted a decree nisi, to be moved absolute at the end of three months. Petitioner was given the custody of the children, with liberty to the mother to apply as to access of the children. An order was made for the co-defendant to pay the costs of the suit.

After William Henry SCARR died in 1906, Ada married Albert Magnus HUNGERBUHLER and subsequently divorced him in 1919. Ada died under her maiden name and is buried with William`s parents and her parents.


HUNGERBUHLER v. HUNGERBUHLER.

Mr. O'Rourke (instructed by Messrs. O'Shea and O'Shea) appeared for the petitioner, Ada May Hungerbuhler (formerly Scarr), who sued for a divorce from her husband, Albert Magnus Hungerbuhler (a commercial traveller), on the grounds of misconduct, desertion, and cruelty.
His Honour made an order nisi for the dissolution of the marriage, returnable within three months, with costs against the defendant.
