IN INSOLVENCY JURISDICTION. Before his Honour Mr. Justice Real.
In the Matter of James Rylands.
In the matter of James Rylands, of West Milton, Brisbane, an insolvent, witnesses were examined, Mr. Lukin (instructed by Mr. Leeper) appearing for the official trustee. David Timms, carpenter, formerly of Torwood but now of Laidley, deposed that James Rylands was his father-in-law. He some six years ago worked as a drayman for Rylands, who was engaged by the Brisbane corporation. He worked for him nearly three years. When he left Rylands's service insolvent was indebted to witness to the extent of £25 or £30. Rylands at that time had one horse and dray that belonged to himself, and besides there was a mare that belonged to witness, he having received the animal in lieu of wages. Witness left the mare with Rylands up to a few days before the latter went insolvent. Witness also left a dray and harness with Rylands. It was at the end of April, 1888 that witness left Rylands's service. He bough the dray and harness from Warby and Barker with money he borrowed from Mr. Grose, whom he subsequently repaid. Witness used the dray in question while he was in the servce of Rylands, who afterwards made use of it. He rented two horses and a dray and harness to Rylands. Witness resold the dray, and one of the horses remained with Rvlands till within a few days of his becoming an insolvent. Altogether be rented three horses to Rylands. At the time he purchased the animals in question dray-work was in a flourishing state. When dray-work became slack he went back to his trade as a carpenter, and rented the horses, &c., to Rylands. The animals were purchased on tho time-payment system. Rvlands had paid no money to witness as rent for the use of the horses. He took the dray and the animals away from Rylands because he became tired of waiting for his money. Rylands did not tell him that he had received a writ for £36 from Mr. Moffat. Rylands did not tell witness that he would have to become insolvent, at any rate not that witness could remember. He could not say when he first received an intimation that Rylands was going insolvent. Moffat never showed him the writ. He could not remember Rylands showing him the writ; he showed him a bill. After seeing the bill witness said he might us well have his property as any body else. Rylands then said he thought Moffatt or Grose would push him. At that time Rylands owed him about £40, £20 of that being for rent. He had lent money to his father-in-law, but he could not state how much; it might he about £10. Rylands owed him £5 or so for work done. The insolvent never at any time gave him property to keep.
This closed the examination.
