James Lavercombe was charged with illegally detaining a bay mare, the property of Daniel Sullivan. Mr. Harris for the defence. Sullivan's evidence was to the effect that he got the mare of Jeremiah Sweeney, about two years since to break in, and gave a horse in exchange for it; that he then left the district, asking Sweeney to look after the mare ; and that now, when he returned, he found her in possession of defendant, who refused to give her up. For the defence, Sweeney was called, who said he gave the mare to Sullivan to break to harness and agreed to let him have the use of her, for six months in payment; then, when he went for her, Sullivan induced him to let her remain in his possession as he had no other horse to take her place in his team. He allowed her to remain a further six or seven months, when he went again for her, but Sullivan had lost her. Sullivan subsequently gave him a horse as recompense for the time he had kept the mare, but he refused to pay the value, £18, and he went away. Sometime afterwards, he (Sweeney) recovered the mare, and sold her to Lavercome, the defendant.
Case dismissed.
