WHARF WORKER WINS APPEAL

The Full Court yesterday set aside a decision by Mr. J. H. Moore, S.M., Townsville, fining Francis Joseph Sponza, waterside worker, £3, with £6/8/6 costs and witnesses' expenses, on a charge of haying committed a breach of the waterside workers' award. Sponza was allowed costs. The charge was that on June 17 Sponza, having accepted engagement by the Adelaide Steamship Company for bunkering and trimming coal on the steamship Allara, refused to start work, contrary to the award. Mr. Justice Philp said in his judgment that the prosecution had failed to prove that Sponza accepted an engagement as alleged. There was no evidence of any offer of an engagement accepted by Sponza. Mr. Justice E. A. Douglas, Mr.

Justice Philp, and Mr. Acting Justice Stanley were on the bench. Mr. A. D. McGlll, K.C., with Mr. M. J. Hoare (instructed by Messrs. Morris, Fletcher and Cross, as town agents for Messrs. Connolly, Suthers, and Walker), appeared for the Adelaide Steamship Company, and Mr. K. Townley (instructed by Messrs. Tully and Wilson, as town

agents for Messrs. Wilson, Ryan, and Grose) for Sponza.

OBITUARY.
Mrs. Janet Potts

Mrs. Janet Potts (nee Kirk) who died recently at Newmarket, Brisbane, spent her childhood days at Logan Village where her people were engaged in farming and dairying in the early '80's. She married Mr. John Potts who kept a saddlery and boot shop at Logan Village for years. He also had three mail contracts — a coach mail from Logan Village to Canungra, and two horse mails, Tambourine to Jimboomba, and Logan Village to Greenbank. Mrs. Potts was widely known for her hospitality. Her husband predeceased her last year. She is survived by an adult family. Mr. Potts was a member of the old Tambourine Divisional Board and was instrumental in having the first bridge over the Logan River at Logan Village built. It was washed away in one of the floods in the '90's. Mr. A. Rick, saddler, of Waterford, served his apprenticeship as saddler in the shop, and ran the mail from Logan Village to Greenbank in 1890 and 1891.
